Unlicensed Contractors Caught in Sting

Five unlicensed contractors suspected of defrauding new homeowners in Elk Grove have been arrested in a sting operation set up by the California State Contractors Board and the Statewide Investigative Fraud Team.

The five were involved in unlicensed concrete work for Aloha Concrete, TJ Concrete, Little Junior, and All Seasons Concrete, authorities said. The businesses saturated new housing developments with fliers and business cards advertising concrete work, according to the CSCB.

Neva Fainu is charged with contracting without a license, illegal advertising and using someone else's contractor's license. Toutali Esekia is charged with contracting without a license and illegal advertising. Moeta Tuutu faces charges of contracting without a license, illegal advertising, burglary and conspiracy. His wife, Silila Ofiu faces the same charges. Lote Taufa is charged wtith contracting without a license, illegal advertising and will be extradited to Nevada where he faces other criminal charges.

All five had been arrested for similar violations in the past and now face stiff penalties, including three months in jail if convicted.

"Consumers need to recognize the dangers of hiring unlicensed operators," said CSLB Registrar Steve Sands. "They can do a lot of damage. That is why it is so important to make sure the person they hire has a valid license by checking them out with the Board."

The State Contractors Board recommends homeowners hire only licensed contractors who carry workers compensation to do remodeling or repairs. Unlicensed workers often do not carry workers compensation insurance, and if a worker is injured, the homeowner could be liable. Also, officials say that if work is not completed satisfactorily, the homeowner often has little recourse.

Scalable companies — a venture capitalist’s dream (consider Google) — are capable of fast, often explosive growth. They are disruptive with their innovative products, own significant intellectual property, operate with a winning management team. They possess other unfair advantages over the less-sexy-but-more-common “lifestyle” startup companies (privately held, founder-run, with up to $10 million in revenue).
Scalable startups balance metaphorically on a three-legged stool. Lifestyle startups tilt only on one and need two other legs — venture funding and excellent legal services. After initial funding, which is either self-infused or an emotional investment by family and friends, venture capital for lifestyles comes primarily from VC firms and angels.
If you’re considering VC funding to launch your company, the first question to answer is whether it’s a lifestyle or scalable company. Either way, in the Sacramento region, venture money could be there for the asking.

Sacramento’s Startup Climate
The startup climate is warming up after languishing in the backwaters of the dotcom craze and subsequent ebb tide. Five years ago, Sacramento had virtually no capital market and few world-class private enterprises. Now, several active VC firms and angels (private investors) exist. They concur that during the fourth quarter of 2004, more startups were knocking on their doors and presenting business plans than they’ve seen in years. More initial funding events closed, including the recent funding of JIWire.
In fact, much of the infrastructure is in place to establish Sacramento as a global technology center. According to Dan Lankford, managing director of Capital Valley Ventures, “Sacramento currently has available about 0.4 percent of the VC market” (the total funds invested by VCs annually in the United States). For perspective, consider Denver, with startups now enjoying 4 percent of the VC market share and 16 VC offices. Denver recorded Sacramento-type VC spending numbers about 10 years ago.
Thanks to tech giants Intel and HP, drawing high-tech talent to the region from all over the world, intellectual and venture capital is proliferating. However, a common sentiment in the startup community — fledging companies, funding sources and interested agencies and nonprofits — is that Sacramento startups need even stronger capital opportunities. And, they would benefit from an outside perception of a clear, definitive persona of the region to draw the executive and technical talent that fosters startup fever.
Ian Westberg is regional manager of DLA Piper Rudnick Gray Cary Venture Pipeline LLP, a subsidiary of the law firm. Led by non-lawyers with experience in technology, the internal pipeline group focuses on tomorrow by assisting startups in innovative, informal ways to foster the best interests of the local startup community. Westberg is bullish on Sacramento. He says, “The pump is primed. Several local companies have bootstrapped themselves to raise venture capital. We are working with many of them to make a launch at VCs this year.”
When seeking investors, Westberg warns, it is essential to find the right one. “When you are looking for an investor, look at it like a marriage. You’ll spend a lot of time with these people. It isn’t about money — it’s about smart money.”

I enjoyed Amanda Kooser's and Mike Hogan's February articles on IP-PBX phone systems, VoIP, Wi-Fi and how small companies use technology to stay connected ("Wherever You Go, There You Are" and "Connections"). These technologies have increased my productivity and lowered my communications costs. What's more, they have kept me closer to my customers than ever before and helped me close new contacts.

In fact, I recently utilized technology from GotVMail to land a sizable contract while my wife was driving the family on I-94 through Chicago at 65 mph. A potential customer called my GotVMail toll-free number and was forwarded to my mobile phone. The prospect needed a service-level agreement to be signed and faxed back right away. The document was faxed to my GotVMail number, and I downloaded the PDF file from my e-mail inbox with my tablet PC and mobile phone. I signed the agreement with my tablet PC and faxed it back. The task took 10 minutes without stopping at an office to print or fax the document. We didn't even have to get out of the car.

While many films stars and sports figures got milk, an estimated 10,000 small businesses have GotVMail in an effort to present a big business presence to their customers—but minus the long-term commitment, equipment and ongoing expenses associated with the telephone systems of the rich and famous.

These small businesses, be they CLECs, mom-and-pop shops, or work-at-home professionals, all need the core functionality of today’s big-ticket telephone systems and software. The answer: a pay-as-you-go hosted PBX service that for a small monthly fee, offers a toll-free and/or local number, custom greeting/autoattendant, multiple extensions with mailboxes, dial-by-name capability, live call forwarding and instant Web and e-mail delivery.

The GotVMail Virtual One communications service represents an opportunity for small firms, CLECS, ISPs and resellers looking to target the lucrative small operations market, which at last check accounted for well over 90 percent of all U.S. businesses. Beyond providing an enhanced image, the service is also designed to help customers boost productivity without sacrificing handling customers with professionalism, according to the company.

“We’re looking at putting an affordable face on small business operations and home-based businesses that can’t afford the expensive equipment, software and support services associated with Fortune 1000 PBXs,’’ explained Siamak Taghaddos, president and CEO of GotVMail. Customers pay a $40 fee and a $25 activation charge the first month and then 7 cents a minute for calls which, with features, represents roughly one-fifth the cost of PBX maintenance alone, he added.

In addition to selling to end users, GotVMail has been aggressive in recruiting partners to help broaden the sales reach of the service. Of note, the hosted PBX service provider inked a pact with Pitney Bowes Inc.’s PBDirect unit to offer a program comprising a small business outreach campaign consisting of discounts on the core service, website promotions (www.pitneyworks.com/dealzone) and direct mail and permission-based e-mail offers. The company is targeting PBDirect’s 840,000 small business customers with the undertaking.

But while the service has received strong marks from analysts, the company needs to go well beyond this deal to sustain success in this volume-oriented business. “It’s a great little service that I’ve used, but they need to keep building up a distribution channel,’’ said Deb Mielke, president of Trelliage Network Strategies. “They need to reach as many people as quickly as possible, which would make teaming with bloggers a great idea.”

When it comes to hosted services, PBX or other, GotVMail is capitalizing on the affordable abundance of hosting facilities, which were hugely overbuilt starting in the late 1990s. This service is hosted out of two such centers, one in New York City and one in Somerville, Mass. To that end, GotVMail and similar providers are actually customers of hosted service center operators, in this case in New York City.

How it works:

1) When calling a toll-free number or local GotVMail VirtualOne account number, a caller hears the company’s customized main greeting and is instructed to choose an extension or dial 8 for the dial-by name directory.
2) The caller dials 1 for sales and is then placed on hold with music while being transferred to the designated employee’s cell phone or home office. The employee can then choose to accept the call or place it in voicemail.
3) If a message is left, the VirtualOne service notifies the employee of the message instantly by calling him or her and e-mailing the voicemail in MP3 format.

While hosted services are hardly new, offering ones focused on cost avoidance and targeting them toward small business represents a new wrinkle in a growing market segment.

Business - Jack Sirard: Many have questions about state amnesty on past-due taxes - sacbee.com: "The tax-filing season adds a little more to everyone's fully loaded plates.

Facing the April 15 tax deadline, taxpayers must cope with either the tax laws or personal situations that change from year to year.

But some California taxpayers have another deadline to worry about: March 31. That's the last day they will be able to seek amnesty for past-due income, franchise and sales taxes and be able to avoid penalties and possible prosecution.

An estimated 1.7 million individual and business taxpayers are potentially eligible for the amnesty, and if all goes as planned, the state could collect about $670 million.

But things would have to pick up. Through Wednesday, the state has raised $8.6 million from 24,374 applications.

Since so many people have so many questions about taxes in general and the amnesty program in particular, The Bee invited enrolled agent Mary Philippsen, owner of By the Numbers in Fair Oaks, and Denise Azimi, public affairs spokeswoman for the Franchise Tax Board, for an online tax chat.

Here are some of the questions they received this week and their answers:

Q: Would you explain a little about the amnesty program? I have a friend who might benefit, but I'm unsure how to use it.

Azimi: Tax amnesty is a limited-time chance for both individuals and businesses to pay back taxes without paying most penalties and fees.

It will save many people lots of money. Amnesty runs through March 31, so be sure to act quickly. It applies to income, franchise, sales, and use taxes owed for 2002 and prior years. For more information, go to www.taxes.ca.gov.

Q: Will the Internal Revenue Service have an amnesty program now or in the future?

Azimi: Not currently, and there has been no talk about one in the future.

Q: If one were to take advantage of the tax amnesty offer, will the information be shared with the IRS?

Azimi: Yes, the Franchise Tax Board does share tax information with the IRS. Although I cannot speak directly to what the IRS will do, they have issued a news statement that says they generally look favorably on taxpayers who step forward and self-assess the taxes they owe.

Q: My friend hasn't filed his taxes for four years. He thinks this is no problem because he was due a small refund for each of the years. I think that amnesty would be a good idea nonetheless.

Azimi: Your friend really should file because the normal four-year statue of limitations to audit does not start to run until the taxpayer files a return.

However, if your friend is due a refund, amnesty will not really help because there will be no penalties to waive. More likely, your friend would benefit by filing outside of the amnesty program.

Q: In this amnesty, when do the taxes need to be paid? Will payments be accepted, or a lump sum?

Azimi: Amnesty payments in general are due by May 31. Remember to get that application in by March 31 though. For those who cannot make full payment by May 31, the FTB will set up installment plans allowing taxpayers to pay their amnesty balance through June 30, 2006.

Q: What will the penalty be for those who don't take advantage of the amnesty?

Azimi: Anyone who is eligible to participate in amnesty but does not take advantage of the offer gets an amnesty penalty. It is equal to 50 percent of the interest amount computed from the original due date of the return through March 31, 2005.

Q: I get unsolicited mail from so-called tax experts in the mail, and have seen their ads on television. Are these legitimate tax experts? Does it pay to hire their services?

Philippsen: As with anything in life, my theory is: "If it sounds too good to be true, generally it is." As a general rule it pays to do your homework, ask for referrals and check the Better Business Bureau.

Q: If the state has filed tax liens on someone based on tax estimates, can these estimates be disputed, as part of the amnesty program?

Azimi: Absolutely! This happens when we have income information such as W-2s, 1099s, etc. When taxpayers do not file returns after we have contacted them requesting the returns, we will issue tax assessments based on the information we have.

If the tax assessments are for 2002 or prior, please look into amnesty. In any case, you can file an accurate return for the years where we have estimated your tax liability and correct it.

Q: What does it cost to hire an enrolled agent to help in preparing back tax returns, for an individual with modest income?

Philippsen: Enrolled agents are considered the tax experts and charge based on the income tax situation. There is no flat fee or rate that can be set because this is not allowed by law. You would need to contact an enrolled agent and arrange a meeting to determine the scope of the engagement and discuss fees. Some EA's offer the first consultation for free.

Q: Does the state do Offer in Compromises? If so, what do tax bills settle for, as a percentage of what is owed?

Azimi: For information on our Offer in Compromise program, check out frequently asked questions at www.ftb.ca.gov/individuals/Bills/OIC.html.

Q: What's an enrolled agent?

Philippsen: An enrolled agent is a tax practitioner licensed by the federal government to prepare tax returns and represent the taxpayer before the Internal Revenue Service. We can practice anywhere in the United States since we are federally licensed. We are required to take a two-day exam in all areas of federal taxation and ethics. We also are required to take a minimum of 72 hours of continuing education.

Q: In re-creating tax returns for past years, how accurate do they need to be and will they be carefully reviewed or audited?

Azimi: The returns should be as accurate as possible since you will be signing them under penalty of perjury. Amnesty returns are subject to the same criteria as other tax returns when it comes to audit selection.

Philippsen: You may to contact a practitioner to assist you as a practitioner can get a hold of transcripts from both the IRS and FTB to help identify missing information.

Philanthropy, not just career success, characterized this year's winners of the Sacramento Metropolitan Chamber of Commerce's awards, bestowed Friday evening at the chamber's 110th annual awards dinner at the Hyatt Regency.

UC Davis Chancellor Larry Vanderhoef was chosen the 37th Sacramentan of the Year, while Businesswoman of the Year went to River City Bank Chief Executive Jeanne Reaves, and Sleep Train founder Dale Carlsen was named Businessman of the Year.

"The chamber selection committee takes into consideration not only whether they are successful running their business but are they making a contribution to their community as well," said chamber President Matt Mahood.

Vanderhoef, who's been UC Davis chancellor since 1994, has overseen major growth on and off campus, including a 3 million-square-foot expansion of the UC Davis Medical Center in Sacramento.

Among other things, he formed a group that brings school superintendents, college presidents and university chancellors together to find ways to ensure that disadvantaged youths can go to college.

Reaves, a Sacramento native, began her 44-year banking career as a secretary in 1961, joining River City Bank in 1990. She's credited with bolstering the bank's commitment to community involvement and sits on the boards of numerous organizations, including Sutter Health, Families First and Make a Wish Foundation.

"When she's on a board she's fully committed to that organization, said Barbara Hayes, president of the Sacramento Area Commerce and Trade Organization.

Carlsen opened his first mattress store in Sacramento shortly after graduating from California State University, Sacramento, in 1984. He quickly expanded across California and into Oregon and Washington. We haven't seen snow like this in years.

So, head out to the garage and untangle that sled, silver saucer or tour de tundra toboggan. Tune up those twin tips and wax that snowboard. Mate up those skinny skis and grab the gaiters for those snowshoes.

Wave goodbye to the valley and head up the hill. There's no stopping you now.

A spectacular winter wonderland awaits on the three-day weekend. But before you leave town, take a minute to consult our Outbound guide to the great outdoors.

We've done some research on the snow parks, ski resorts and Nordic centers. We've discovered some deals, provided some directions and even gotten a go-ahead wink from the weather service.

Now, all you have to do is get out and go.

Skiing, snowboarding
Record snowfall has left Tahoe ski resorts with almost too much of a good thing - as in 15 feet to 20 feet of fresh pow-pow and a weekend weather forecast sure to bring out the crowds.

The series of storms the past two weeks forced many resorts to temporarily close lifts and terrain due to high winds and whiteout conditions. Both Interstate 80 and Highway 50 were closed intermittently and under chain restrictions for days.

Now comes the payoff.

"Even if you don't ski or snowboard, there are lots of ways to get up here and enjoy Tahoe, which is the whole point," said Rachel Woods, spokeswoman for three North Shore resorts.

A few things to keep in mind if you're headed that way on the upcoming Martin Luther King Jr. holiday weekend:

* Check road conditions by calling Cal-Trans at (800) 427-7623. Pack chains, shovel, water and emergency rations. Road conditions can change in a flash - a single highway spinout can cause traffic to back up for hours. Be prepared.

* All that new snow means a higher risk of avalanche. Stay in bounds at resorts and use only groomed, marked trails for other activities.

* Get an early start. Arrive later than 9:30 a.m. or so and you may be directed to an overflow parking lot served by shuttles instead of being able to park and walk to the lifts. For smooth sailing on the way home, leave by 3 p.m.

* If Sierra-at-Tahoe is your destination, consider taking the West Slope Shuttle. The bus runs Saturdays and Sundays starting this weekend, with pickups at Clark's Snow Sports, 3515 Sunrise Blvd., Rancho Cordova (6:30 a.m.), the Hilton Garden Inn, 221 Iron Point Road, Folsom (7 a.m.) and PLA Snowboards, 103 Main St., Placerville (7:30 a.m.). Arrival at Sierra is scheduled for 9 a.m., with afternoon departure at 4:15 p.m. Cost of a round trip with lift ticket is $59 general, $51 for young adults and $39 for children. A shuttle ride with a learn-to-ski or ride package is $79, while transportation only is $29. Passengers under 18 must have a parent fill out a liability-release form. * Stay the night; skip the traffic. For this weekend, the North Lake Tahoe Resort Association is offering packages beginning at $166 per person (plus tax, based on double occupancy) for three nights lodging and a two-day interchangeable lift ticket good at North Shore resorts. * Check event listings. If you want to see some of the world's top extreme athletes in action, this is a good weekend to head to Sugar Bowl or Alpine Meadows.

Sugar Bowl is hosting the Jabra X-Jam, Friday through Sunday, with athletes from around the world competing for the last remaining spots in skiercross and boardercross for the X Games finals Jan. 29-Feb. 1 in Aspen, Colo. Boardercross is a newly sanctioned event for the 2006 Olympics. In both disciplines, competitors race in heats of six racers on winding, downhill courses groomed with iced S-curves, hits, tables and bumps. Spectators with lift tickets watch from the side of the course, while anyone can join the deck party at the Mount Judah Lodge. For more information: (530) 426-6724 or www.sugarbowl.com.

Just over Donner Pass at Alpine Meadows, the Snowbomb Sick & Twisted Big Air Competition, originally scheduled for last weekend, has been reset for this Saturday. Open to pro and amateur skiers and snowboarders, the event takes place on a specially built jump in the Kangaroo Terrain Park, just steps from the main base lodge. Sno-Parks
Wouldn't it be nice if you could just drive into the mountains, pull safely off the highway, park the car and get right into playing in the snow?

Well yes, it is nice. Snow parks, officially called Sno-Parks, where you can do just that, are located all over the central Sierra, and 15 are clustered in our area (see map on this page) for the convenience of visitors who want to park and play.

After the recent spate of storms, there will be plenty of "sno" to go with the "park," says Joe Rosato, a spokesman for the state park system.

"We expect all 15 area Sno-Parks to be open by the weekend," he said Tuesday.

Here are a few tips for using Sno-Parks:

* Sno-Parks off Interstate 80 are located at Yuba Gap, Donner Summit and Donner Lake, and permits are available at those locations. Sno-Parks along Highway 50 are at Echo Lake and Echo Summit (permits are also available at the latter location). Sno-Parks along Highway 88 are at Iron Mountain, Meiss Meadow and Carson Pass.

* If you're a snowmobiler or cross-country skier, check the Sno-Parks Web site (address below) to see which location welcomes your sport. Some don't.

* Buy a permit. They cost $5 for a single visit or $25 for the season, which is cheap compared with the $75 fine you'll have to pay if you're cited for not having one. They are available at some convenience stores near the Sno-Parks, but you'd be wise to buy them ahead or on the road to the mountains.

Note: AAA and REI no longer sell Sno-Park passes. Places to buy permits include:

In the Sacramento area, Anytime Power Sports, 4837 Auburn Blvd. at Madison Avenue (916-349-2100; open Mondays-Fridays 9-6, Saturdays 9-4, closed Sundays).

On I-80, at the California Welcome Center, 13411 Lincoln Way, just off the Foresthill exit in Auburn (530-887-2111, open Mondays-Fridays 9:30-4:30, Saturdays 9-3, Sundays 11-3).

On Highway 50, at the Placerville Ranger District, off the Cedar Grove exit eight miles east of Placerville (weekdays only, 8-4:30). Beyond that, at the Silver Fork Store, the Kyburz Mini-mart and the Strawberry Market.

* Arrive early. With all the deferred visits during the recent storms, Rosato expects large crowds this weekend at the Sno-Parks, where parking is limited.

The rules of the slopes
Whether or not you decide to get a helmet, here are some rules from the National Ski Areas Association called Your Responsibility Code that will help you and others stay safe on the slopes:

* Stay in control and be able to stop or avoid other people or objects.

* People ahead of you have the right of way. It is your responsibility to avoid them.

* You must not stop where you obstruct a trail or where you are not visible from above.

* Whenever starting downhill or merging into a trail, look uphill and yield to others.

* Always use devices to help prevent runaway equipment.

* Observe all posted signs and warnings. Keep off closed trails and out of closed areas.

* Before using any lift, you must have the ability to load, ride and unload safely.

Today, she operates a dog-training business based in Elk Grove, A.L.L. Dog Training, and travels the region teaching individuals and groups how to make the most of their relationships with their pets.

Tijan-Smith said she grew up with animals and developed many of her techniques over the years.

'I use dog psychology based on what a pack situation would be like,' she said. 'That's how dogs think. It's not about what you (the pet owners) think. It's how your dog looks at it and the positive reinforcement that goes along with that.'

The number of Tijan-Smith's clients has soared through personal referrals - about 150 clients today, more than double last year's number.

The most effective and lasting training, she said, emphasizes the owner's behavior rather than the animal's behavior. Dog owners, for example, must gain a pet's respect by establishing authority.

'If your dog doesn't respect you, why would the dog listen to you?' Tijan-Smith said.

That sounds simple, but it's a challenge for owners accustomed to relinquishing authority to their pet.

Tijan-Smith, who regularly does volunteer work on behalf of animals, is establishing a nonprofit animal rescue organization that will focus on dogs and horses."

An unpatched, months-old vulnerability in Microsoft's Internet Explorer is now even more dangerous, security firms reported Monday.

Danish security vendor Secunia warned that new exploits of an earlier series of vulnerabilities in IE now let hackers compromise Windows computers without any more work than enticing users to malicious Web sites.

In August and then again in October 2004, Secunia broadcast warnings of similar threats to IE, but at the latter date posted proof-of-concept code which required the user to actually drag and drop a file within the browser to be at risk. The exploits now in the wild, said Secunia and the SAN Institute's Internet Storm Center, are automated and require no user action except visiting a hacker-constructed site.

In response, Secunia upped its assessment of the vulnerability to "extremely critical,' its most dire warning.

The three vulnerabilities noted by Secunia affect Internet Explorer 6.x, including the version bundled with Windows XP Service Pack 2 (SP2), the massive update from last October which was touted by Microsoft as a major security upgrade.

SAN Institute's Internet Storm Center confirmed the vulnerabilities, which "will allow remote code execution on a victim's system just by visiting the [malicious] site."

The Center said it had received e-mail with a link to such a site -- users would still have to be drawn to the site -- and noted that "as of now, there is no patch available."

Secunia has posted an online test that users can run to determine if their browser is vulnerable.

Until a patch is available, IE users should consider switching browsers, said Secunia, or disabling the "Drag and Drop or copy and paste files option in Internet Explorer. Microsoft has posted a document on its support site that explains the process.

We offer customized classes and multiple training techniques that many other trainers do not- plus- we do not "treat train". Everything begins with a FREE IN-HOME CONSULTATION to assess your pets personality/temperment and your families goals both short and long term. It is our job to develop a training package that suits your lifestyle and busy schedule as well as paying attention to what your dog is willing to offer. Our clients learn how to train their own dog through leadership, loyalty and love. Plus, training is completed on YOUR TIME and with YOUR SCHEDULE in mind so it does not become another unwanted commitment, which will make you not want to complete the program. All dogs in the same household are included for one cost.
